You need to file an appeal under Ban Appeals, perhaps with a relevant excerpt from your client logs (they will need to dig through the server logs to prove anything, which is probably so annoying that they won't even bother dealing with your appeal).
If the mute was for nickname abuse, that would be the given reason (not Spam), and his ability to use /nick would be taken away.
However, the rule says:
A common-sense reading of "staff impersonation" not being allowed is that other types of impersonation are allowed - and indeed, I have personally impersonated civilians to do some minor trolling and faced no consequences. That said, you could still get punished if you used player impersonation to send messages that otherwise break the rules.
